Terms of Service
Welcome to VideoGames254. These Terms govern your access to and use of the videogames254.com website, the Mobile TPS Android game, and any related services (together, the “Service”). By creating an account, making a purchase, or installing a game obtained from VideoGames254, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are
The Service is operated by VideoGames254. You can reach us at [email protected] for any question about these Terms, your account, a purchase, or a license.
2. Eligibility
You must be at least 13 years old to create an account or make a purchase. If you are under the age of majority in your country, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. We may refuse, suspend, or close accounts that we reasonably believe belong to underage users.
3. Your account
- You are responsible for keeping your login credentials, passkeys, and two-factor codes secure.
- Don't share your account or your M-Pesa receipts with people you don't trust — anyone with access can activate downloads against your purchases.
- Tell us at [email protected] as soon as you suspect unauthorised access.
- One person, one account. Don't create multiple accounts to abuse promos, referrals, or activation limits.
4. Purchases and payment
Game purchases are processed through M-Pesa. By initiating a purchase you authorise the listed amount to be charged to the M-Pesa number you provide. A purchase is complete only when the M-Pesa callback confirms a successful payment and we issue you a download token.
Prices are shown in Kenyan Shillings (KES) and may change at any time, but a change will never affect a purchase that has already been confirmed.
5. Refunds
Because games are delivered as digital downloads that bind to your device on first activation, we don't offer automatic refunds. We do review refund requests on a case-by-case basis — for example, if a payment was double-charged, if the download is genuinely unusable on a supported device, or if the purchase was fraudulent.
Email [email protected] with your M-Pesa receipt and a description of the problem. We aim to respond within a few working days.
6. Your license to the games
When you complete a purchase, we grant you a personal, non-exclusive, non-transferable, revocable license to install and play the game for your own enjoyment. You do not own the game itself, and the license is bounded by the rules in this section.
7. Anti-piracy and device binding
Each purchase carries a lifetime budget of five (5) device activations. Reinstalling on the same device, factory resets, and moving to a new phone all count against this budget. Need more activations because of a legitimate situation (new phone, lost device)? Contact support and we'll usually help.
You agree that you will not:
- Share, sell, lend, or upload an APK obtained from VideoGames254 to anyone else, any forum, or any file-sharing service.
- Decompile, reverse-engineer, modify, or attempt to bypass the license-ping or activation checks built into the game.
- Patch, repackage, or distribute a modified build of any game.
- Use VPNs, emulators, or device-spoofing tools to acquire extra activations or evade fraud checks.
- Operate any automated tool that hits our license or download endpoints at abnormal volume.
License pings include data described in the Privacy Policy. Repeated failed activations, mismatched device fingerprints, or signs of redistribution may cause your licenses to be revoked.
8. Referral program
If you participate as a referrer:
- Self-referrals don't count — you can't earn credit on your own purchases or by sharing your link with accounts you control.
- Referral credits are voided if the underlying purchase is refunded, charged back, or flagged as fraudulent.
- Spamming your referral link, paying for fake clicks, or otherwise gaming the program may result in suspension and forfeiture of unpaid credits.
- We may adjust referral rates, payout thresholds, or program rules at any time, with notice posted on the referral dashboard.
9. Comments and other user content
The blog allows signed-in users to leave comments. By posting a comment you grant us a non-exclusive, royalty-free, worldwide license to display, reproduce, and moderate it as part of the Service.
Don't post anything that is unlawful, hateful, harassing, spammy, infringing, sexually explicit, or that exposes other users' private information. We can hide, edit, or delete any comment, and we can suspend the author, without prior notice.
10. Acceptable use
Beyond the specific rules above, you agree not to: probe or stress-test our infrastructure, scrape the site or its API outside of features we offer publicly, impersonate other people, or interfere with anyone else's use of the Service.
11. Suspension and termination
We can suspend or terminate your account, revoke individual licenses, and refuse to provide further service if we reasonably believe you have broken these Terms — including for fraud, piracy, chargeback abuse, or harassment of other users or our team. Where we can, we'll explain why; in cases involving fraud or safety we may act first and explain afterwards.
You can close your account at any time by contacting [email protected]. Sections that by their nature should survive (licensing terms about distribution, disclaimers, governing law) continue to apply after termination.
12. Service availability
We try to keep the site, downloads, and license checks running smoothly, but we don't guarantee uninterrupted access. Maintenance, network outages, M-Pesa downtime, and force-majeure events may all temporarily affect the Service.
13. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We don't warrant that the Service will be error-free, that any specific game will run on any specific device, or that license checks will be available at all times.
14. Limitation of liability
To the maximum extent permitted by law, VideoGames254 will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of your use of the Service. Our total liability for any claim related to a purchase will not exceed the amount you paid for that purchase.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we'll update the date at the top of this page. If a change is material — for example, new restrictions on how you can use a game — we'll surface it more prominently. Continued use of the Service after a change means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of Kenya. Any dispute that can't be resolved by talking to us first will be subject to the exclusive jurisdiction of the courts of Kenya.
